شروط الخدمة
مرحبًا بك في نوت آرت. تحكم هذه الشروط استخدامك للمتجر وشراء المنتجات والخدمات المتاحة من خلاله. باستخدام المتجر أو إتمام طلب، فإنك توافق على هذه الشروط والسياسات الأخرى المنشورة على المتجر، مع عدم الإخلال بأي حقوق إلزامية يمنحها لك القانون.
استخدام المتجر
يجب استخدام المتجر بصورة قانونية، وتقديم معلومات صحيحة وحديثة وكاملة عند إتمام أي طلب.
يتحمل العميل مسؤولية الحفاظ على سرية بيانات حسابه، إن وُجد، وعن النشاط الذي يتم من خلاله.
المنتجات
نسعى إلى عرض منتجات نوت آرت وصورها وأوصافها ومقاساتها وألوانها بأكبر قدر ممكن من الدقة.
قد تظهر اختلافات بسيطة في درجات الألوان أو المظهر نتيجة اختلاف الشاشات أو الإضاءة أو التصوير أو طبيعة عملية الطباعة.
يجوز تحديث المنتجات أو أوصافها أو أسعارها أو إيقاف عرضها عند الحاجة، مع عدم التأثير على الحقوق التي نشأت عن الطلبات المؤكدة وفقًا للقانون.
الطلبات
عند تقديم طلب من خلال المتجر، يجب مراجعة المنتج والمقاس واللون والكمية وبيانات التوصيل وأي اختيارات أخرى بعناية.
لا يبدأ تجهيز أو إنتاج الطلب الذي يتطلب دفعًا مسبقًا إلا بعد استلام المبلغ المطلوب والتحقق من عملية الدفع.
يجوز لنوت آرت التواصل مع العميل إذا كانت هناك مشكلة في الطلب أو البيانات المقدمة أو توافر المنتج أو إمكانية تنفيذه.
إذا تعذر علينا تنفيذ طلب بعد استلام قيمته، سنتواصل مع العميل للوصول إلى الحل المناسب ورد أي مبالغ مستحقة عند الاقتضاء.
الدفع والأسعار
تكون الأسعار المعروضة على المتجر سارية وقت إتمام الطلب، ما لم يوجد خطأ واضح أو يتم توضيح خلاف ذلك.
يجب سداد القيمة المطلوبة بالكامل باستخدام وسيلة الدفع المتاحة والمعلنة عند إتمام الطلب.
لا يعتبر الطلب مدفوعًا حتى يتم استلام المبلغ والتحقق من عملية الدفع.
يتحمل العميل مسؤولية مراجعة بيانات الدفع والمبلغ المطلوب قبل إتمام عملية الدفع.
قد تختلف تكاليف الشحن والرسوم أو الضرائب أو الرسوم الجمركية حسب مكان العميل وطبيعة الطلب، ويتم توضيح ما ينطبق منها عند الإمكان.
التجهيز والإنتاج
يتم تجهيز وإنتاج معظم منتجات نوت آرت بعد تأكيد الطلب.
يبدأ التجهيز بعد تأكيد استلام المبلغ المطلوب. ويمكن طلب إلغاء الطلب قبل بدء التجهيز أو الإنتاج.
بعد بدء التجهيز أو الإنتاج، قد لا يكون الإلغاء ممكنًا في الحالات التي يسمح بها القانون.
تخضع حالات الإلغاء والاستبدال والاسترجاع لسياسة الاستبدال والاسترجاع والإلغاء المنشورة على المتجر والقوانين واجبة التطبيق.
المقاسات والاختيارات
يتحمل العميل مسؤولية مراجعة المقاس واللون والخيارات التي قام بتحديدها قبل تأكيد الطلب.
إذا قامت نوت آرت بإرسال المنتج مطابقًا للمقاس واللون والخيارات التي حددها العميل، فإن اختيار مقاس أو خيار غير مناسب من جانب العميل لا يعتبر في حد ذاته عيبًا في المنتج، مع عدم الإخلال بأي حقوق إلزامية مقررة قانونًا للمستهلك.
الشحن والتوصيل
المدة المتوقعة لتجهيز وتوصيل الطلبات داخل مصر هي من خمسة إلى سبعة أيام عمل في الظروف المعتادة.
هذه المدة تقديرية وليست ضمانًا مطلقًا، وقد تتأثر بشركات الشحن أو الظروف الخارجة عن السيطرة المعقولة لنوت آرت.
إذا حدث تأخير جوهري في الطلب، نسعى إلى التواصل مع العميل عند الحاجة.
بالنسبة للطلبات خارج مصر، يجب التواصل مع نوت آرت قبل إتمام الطلب لتأكيد إمكانية الشحن وتكلفته والمدة المتوقعة للتوصيل.
قد تخضع الطلبات الدولية لرسوم جمركية أو ضرائب أو رسوم استيراد تفرضها دولة الاستلام. يتحمل العميل هذه الرسوم ما لم يتم الإعلان أو الاتفاق صراحةً على خلاف ذلك.
الاستبدال والاسترجاع والإلغاء
تخضع طلبات الإلغاء والاستبدال والاسترجاع لسياسة الاستبدال والاسترجاع والإلغاء المنشورة على المتجر.
لا تلغي هذه الشروط أي حقوق إلزامية مقررة للمستهلك بموجب القوانين واجبة التطبيق.
بيانات العميل
يجب على العميل تقديم معلومات صحيحة وكاملة، بما في ذلك الاسم وبيانات التواصل وعنوان التوصيل.
لا تتحمل نوت آرت مسؤولية التأخير أو تعذر التوصيل الناتج مباشرة عن معلومات خاطئة أو ناقصة قدمها العميل، وذلك في الحدود التي يسمح بها القانون.
الملكية الفكرية
التصميمات والأعمال الفنية والعناصر البصرية والشعارات والصور والنصوص والمحتوى الأصلي الخاص بنوت آرت محمي بموجب حقوق الملكية الفكرية المطبقة.
لا يجوز نسخ أو إعادة إنتاج أو تعديل أو بيع أو توزيع أو استغلال المحتوى المملوك لنوت آرت تجاريًا دون إذن مسبق، إلا في الحالات التي يسمح بها القانون.
تبقى العلامات والمحتويات المملوكة لأطراف أخرى ملكًا لأصحابها.
الخدمات والروابط الخارجية
قد يتضمن المتجر خدمات أو أدوات أو روابط تقدمها أطراف أخرى.
قد تخضع هذه الخدمات لشروط وسياسات خاصة بمقدميها، وعلى العميل مراجعتها عند استخدامها.
لا تتحمل نوت آرت مسؤولية المواقع أو الخدمات الخارجية المستقلة عنها في الحدود التي يسمح بها القانون.
علاقة المتجر بمنصة التجارة الإلكترونية
يعمل متجر نوت آرت باستخدام منصة تجارة إلكترونية خارجية توفر البنية التقنية اللازمة لتشغيل المتجر.
جميع عمليات البيع والشراء الخاصة بمنتجات نوت آرت تتم بين العميل ونوت آرت، وتظل نوت آرت مسؤولة عن الطلبات والمنتجات وخدمة العملاء والحقوق المرتبطة بالبيع وفقًا للقوانين واجبة التطبيق.
الخصوصية
تخضع معالجة البيانات الشخصية لسياسة الخصوصية المنشورة على المتجر.
قد تتم معالجة بعض البيانات بواسطة مزودي الخدمات التقنية والدفع والشحن وغيرهم بالقدر اللازم لتشغيل المتجر وتنفيذ الطلبات، ووفقًا لسياسات الخصوصية والقوانين واجبة التطبيق.
الملاحظات والمحتوى المقدم من العملاء
إذا قام العميل بإرسال تقييم أو تعليق أو اقتراح أو محتوى إلى نوت آرت، فيجب أن يكون له الحق في تقديم هذا المحتوى وألا ينتهك حقوق الآخرين أو القوانين واجبة التطبيق.
يجوز استخدام التقييمات والملاحظات التي يقدمها العملاء فيما يتعلق بتشغيل المتجر وتحسينه والترويج له، في الحدود التي يسمح بها القانون وأي موافقات مطلوبة.
الأخطاء والمعلومات غير الدقيقة
قد تحدث أحيانًا أخطاء كتابية أو تقنية أو معلومات غير دقيقة في وصف المنتجات أو الأسعار أو العروض أو تكاليف الشحن أو مدة التوصيل أو التوافر.
يحق لنوت آرت تصحيح الأخطاء وتحديث المعلومات واتخاذ الإجراء المناسب بشأن الطلب المتأثر، مع احترام حقوق العميل والقوانين واجبة التطبيق.
الاستخدامات المحظورة
لا يجوز استخدام المتجر لأغراض غير قانونية أو احتيالية أو للإضرار بالمتجر أو مستخدميه أو حقوق الآخرين.
ويشمل ذلك محاولة الوصول غير المصرح به إلى الأنظمة أو البيانات، أو نشر برمجيات ضارة، أو جمع بيانات الآخرين بصورة غير مشروعة، أو انتحال شخصية الآخرين، أو انتهاك حقوق الملكية الفكرية.
تعليق أو إنهاء الاستخدام
يجوز لنوت آرت تقييد أو تعليق الوصول إلى المتجر عند وجود استخدام غير قانوني أو إساءة استخدام أو انتهاك جوهري لهذه الشروط، وذلك في الحدود التي يسمح بها القانون.
لا يؤثر إنهاء أو تقييد استخدام المتجر على الالتزامات أو الحقوق التي نشأت بالفعل قبل ذلك.
إخلاء المسؤولية وحدودها
نبذل جهدًا معقولًا للحفاظ على دقة المعلومات واستمرار عمل المتجر، ولكن قد تحدث أعطال أو انقطاعات أو أخطاء تقنية خارجة عن السيطرة المعقولة لنوت آرت.
إلى أقصى حد يسمح به القانون، لا تتحمل نوت آرت المسؤولية عن الخسائر غير المباشرة الناتجة عن استخدام المتجر والتي لا يمكن نسبها بصورة معقولة إلى خطأ من جانب نوت آرت.
لا يهدف أي نص في هذه الشروط إلى استبعاد أو تقييد المسؤولية أو حقوق المستهلك في الحالات التي لا يسمح القانون باستبعادها أو تقييدها.
قابلية فصل الأحكام
إذا تقرر أن أي حكم من هذه الشروط غير قانوني أو غير قابل للتنفيذ، يتم تطبيقه إلى أقصى حد يسمح به القانون، ولا يؤثر ذلك على صلاحية باقي الأحكام.
الاتفاق والسياسات المرتبطة
تُقرأ هذه الشروط مع السياسات الأخرى المنشورة على المتجر، بما في ذلك سياسة الخصوصية وسياسة الاستبدال والاسترجاع والإلغاء وسياسة الشحن.
في حالة وجود تعارض، تطبق القوانين الإلزامية واجبة التطبيق أولًا.
تعديل الشروط
يجوز تحديث هذه الشروط عند الحاجة لتعكس التغييرات في المتجر أو طريقة التشغيل أو المتطلبات القانونية.
تسري النسخة المنشورة وفقًا للقوانين واجبة التطبيق، ولا تؤثر التعديلات على الحقوق التي نشأت للعميل قبل التعديل إذا كانت تلك الحقوق محمية قانونًا.
القانون وحقوق المستهلك
يتم تشغيل نوت آرت من جمهورية مصر العربية، وتخضع المعاملات للقوانين واجبة التطبيق.
بالنسبة للعملاء خارج مصر، قد تكون لهم حقوق إلزامية إضافية بموجب القوانين المطبقة في بلدهم أو مكان استلام الطلب.
لا يهدف أي بند من هذه الشروط إلى إلغاء أو تقييد أي حقوق إلزامية للمستهلك.

يمكن التواصل مع نوت آرت من خلال بيانات التواصل المنشورة في صفحة معلومات الاتصال الخاصة بالمتجر.

OVERVIEW
Welcome to NOTART. The terms "we", "us", and "our" refer to NOTART.
NOTART operates this online store and its related content, features, products, and services. The store is powered by Shopify, which provides the ecommerce platform that enables us to offer our products and services to you.
By accessing or using our store or placing an order, you agree to these Terms of Service together with the other policies published on the store.
Nothing in these Terms is intended to exclude or restrict any mandatory rights available to you under applicable law.
1. ACCESS AND ACCOUNT
You must use the store lawfully and provide accurate, current, and complete information when placing an order.
Where customer accounts are available, you are responsible for maintaining the confidentiality and security of your account credentials and for activity conducted through your account.
2. PRODUCTS
We make reasonable efforts to accurately display and describe our products, including their appearance, sizes, and colors.
Minor variations in color or appearance may occur because of screen settings, lighting, photography, or the nature of the printing process.
Products, descriptions, prices, and availability may be updated or discontinued when necessary, without affecting rights already arising from confirmed orders where protected by applicable law.
3. ORDERS
When placing an order, you are responsible for carefully reviewing the product, size, color, quantity, delivery information, and other selected options.
Where advance payment is required, preparation or production does not begin until the required payment has been received and verified.
NOTART may contact you if there is an issue with your order, the information you provided, product availability, or our ability to fulfill the order.
If we are unable to fulfill an order after receiving payment, we will contact you to provide an appropriate resolution and refund any amount due where applicable.
4. PRICES AND PAYMENT
The price applicable to an order is the price displayed when the order is placed unless there is an obvious error or otherwise clearly stated.
The full amount due must be paid using the payment method made available at checkout.
An order is not considered paid until the required amount has been received and payment has been verified.
Customers are responsible for reviewing payment details and the required amount before completing payment.
Shipping charges, taxes, customs duties, or other charges may vary depending on the destination and circumstances of the order and will be disclosed where applicable and reasonably possible.
5. PREPARATION AND PRODUCTION
Most NOTART products are prepared and produced after an order is confirmed.
Preparation begins after the required payment has been confirmed.
Cancellation may be requested before preparation or production has started. Once preparation or production has begun, cancellation may no longer be possible where permitted by applicable law.
Cancellations, returns, exchanges, and refunds are subject to our published Return, Refund & Cancellation Policy and applicable law.
6. SIZES AND PRODUCT OPTIONS
Customers are responsible for reviewing the size, color, and other options selected before confirming an order.
Where NOTART supplies the product according to the size, color, and options selected by the customer, an incorrect selection made by the customer is not by itself considered a product defect, without limiting mandatory consumer rights.
7. SHIPPING AND DELIVERY
The estimated total preparation and delivery time for orders within Egypt is 5–7 business days under normal circumstances.
This timeframe is an estimate and is not an absolute guarantee. Delivery may be affected by shipping carriers or circumstances outside NOTART's reasonable control.
Where a material delay occurs, we aim to communicate with the customer when appropriate.
For orders outside Egypt, customers should contact NOTART before completing their purchase to confirm shipping availability, shipping cost, and estimated delivery time.
International orders may be subject to customs duties, taxes, or import charges imposed by the destination country. These charges are the customer's responsibility unless explicitly stated or agreed otherwise.
8. RETURNS, REFUNDS, EXCHANGES AND CANCELLATIONS
All cancellation, return, exchange, and refund requests are subject to our published Return, Refund & Cancellation Policy.
Nothing in these Terms removes any mandatory consumer rights available under applicable law.
9. CUSTOMER INFORMATION
Customers must provide accurate and complete information, including their name, contact details, and delivery address.
To the extent permitted by law, NOTART is not responsible for delays or failed delivery directly resulting from incorrect or incomplete information supplied by the customer.
10. INTELLECTUAL PROPERTY
NOTART's original designs, artwork, visual elements, logos, photographs, text, and other original content are protected by applicable intellectual property laws.
Content owned by NOTART may not be copied, reproduced, modified, sold, distributed, or commercially exploited without prior permission except where permitted by law.
Trademarks, content, and intellectual property belonging to third parties remain the property of their respective owners.
11. OPTIONAL TOOLS AND THIRD-PARTY SERVICES
The store may provide access to tools, services, features, or links operated by third parties.
Third-party services may be governed by their own terms and policies. Customers should review those terms when using such services.
To the extent permitted by applicable law, NOTART is not responsible for independent third-party websites or services that are outside our control.
12. RELATIONSHIP WITH SHOPIFY
NOTART is powered by Shopify, which provides the ecommerce technology that enables us to operate the store.
Sales and purchases of NOTART products through the store are made between the customer and NOTART.
NOTART remains responsible for its products, orders, customer service, returns, refunds, and other merchant obligations as required by applicable law.
Shopify may provide separate consumer-facing services governed by Shopify's own terms and privacy policies.
13. PRIVACY
Personal information collected through the store is handled in accordance with our published Privacy Policy.
Certain information may also be processed by Shopify and other service providers as necessary to operate the store, process orders, provide delivery, prevent fraud, or provide other relevant services, subject to applicable privacy laws and policies.

To the fullest extent permitted by applicable law, NOTART is not responsible for indirect losses arising from use of the store that are not reasonably attributable to an act or omission by NOTART.
Nothing in these Terms excludes or limits liability or consumer rights where applicable law does not permit such exclusion or limitation.
19. SEVERABILITY
If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will apply to the fullest extent permitted by law and the remaining provisions will remain in effect.
20. ENTIRE AGREEMENT AND RELATED POLICIES
These Terms should be read together with the other policies published on the store, including our Privacy Policy, Return, Refund & Cancellation Policy, and Shipping Policy.
Where any provision conflicts with mandatory applicable law, the mandatory legal requirement prevails.
21. CHANGES TO THESE TERMS
We may update these Terms when necessary to reflect changes to the store, our operations, or applicable requirements.
The current version published on the store applies subject to applicable law. Changes do not remove rights already acquired by customers where those rights are protected by law.
22. GOVERNING LAW AND CONSUMER RIGHTS
NOTART operates from the Arab Republic of Egypt, and transactions are subject to applicable laws.
Customers outside Egypt may have additional mandatory rights under laws applicable in their jurisdiction or destination country that cannot legally be excluded by these Terms.
Nothing in these Terms is intended to exclude or restrict mandatory consumer rights.
